If an overtime case goes to arbitration instead of judge/jury, how much is the employee worse off?

Why do you assume you would be worse off? The arbitrators are supposed to be neutral. The advantage is that it's much faster to get done and reduces costs on both sides. You should have representation and documentation of the hours you worked.
